  • Information collected from or in connection with credit, know-your-client and other background verifications, including types and amounts of credit, payment history, negative banking items, collection actions, legal proceedings, previous bankruptcy and other credit-related information
  • Information of collected from or in connection with product/service orders, including proof of income (such as pay stubs or notices of assessment), bank account information, employment details (such as occupation and current or former employers)
  • Information provided from or in connection with complaints, inquiries, surveys and customer research

How CHS collects Personal Information

CHS collects information directly from you or those acting on your behalf when you populate and submit forms, request information, obtain services or products as well as information that is automatically collected from internet or other network activity regarding your interaction with our websites. In addition, CHS may also collect information from external data sources such as service providers, social media, joint ventures, government sources, operating systems and platforms, advertising networks, and data analytics providers.

How CHS uses Personal Information

How CHS Shares Personal Information with Third Parties

CHS may transfer your personal information to worldwide CHS subsidiaries and affiliates, service providers, non-affiliated partners, and joint-venture companies.

CHS shares your personal information with non-affiliated third parties only as disclosed in this Privacy Notice. CHS may share your personal data for the following business purposes to:

  • Support internal audit functions with tools for analysis and coordinate with external auditors
  • Include in meeting materials and managing reports of violations against CHS code of conduct standards provided to the Board of Directors

  • Document, track and respond to company legal and compliance investigations, lawsuits, and compliance requirements
  • Provide relevant information about CHS products and services based on individuals signing up to receive such information
  • Provide physical protection of personnel, hardware, software, networks and data from unauthorized physical access and video surveillance

When the processing activity requires your consent, you can refuse consent. In this case, we will inform you of the consequences of not carrying out such activity. If you consent, you can revoke it at any time.

If you want to designate an authorized agent to make a CCPA/CPRA request on your behalf, please contact the CHS Privacy Office in writing per the ‘How to Contact CHS Concerning Your Personal Data’ with a Power of Attorney indicating your designation of an authorized agent. If you are an authorized agent requesting on behalf of a consumer; you may be asked to provide a Power of Attorney.

 

Requests with respect to these rights will be honored within 45 calendar days of the request, but (where permissible) the time period may be extended for another 45 days for complex requests. You will be notified of the reasons required for any extension within 1 month.

Your sensitive personal information will only be collected for lawful purposes and will only be processed when necessary to fulfill the purposes as described in this Privacy Notice, and CHS does and will continue to adopt strict protection measures to protect your sensitive personal information. 3) Your personal information has already been made publicly available by you or through other legitimate means; or,

4) Other circumstances permitted by laws and administrative regulations.

Prior to collecting your personal information from a third party in China, CHS will require the third party to confirm in writing that it has already received consent from you to collect, process and provide us with your personal information, and specify the scope/purposes/means of personal information processing as authorized by you. If the intended processing of your personal information exceeds the scope/purposes/means authorized by you, CHS will contact you either directly or through the third party to secure additional consent.

CHS only use your personal information in accordance with the terms of this Privacy Notice and in compliance with relevant laws and regulations. You have authorized CHS to use your personal information collected by us during the period that we provide products and services to you, unless you have deleted such personal information, rejected our collection at the system setting of the website or your account, or withdrawn your consent by closing your account with CHS or sending a written withdrawal notice to CHS.

CHS may aggregate or anonymize your personal information in such a way that you may not be re-identified by CHS or any other organization. CHS may use such aggregated or anonymized personal information for any purpose without your consent. However, if CHS combines or connects aggregated or anonymized data with your personal information so that it can directly or indirectly identify you, CHS treats the combined information as personal information which will be used in accordance with this Privacy Notice.

CHS may share your personal information with a third party to whom such sharing is necessary to fulfill our contractual obligations to you without your consent, such as providing your order information to our third party suppliers and logistic service vendors. While your personal information will be stored in China, as an integrated part of a global company, CHS utilizes our global resources to manage and support our business and operations throughout the world and to perform our contracts with you. Our products and services may be provided by other members of CHS entities and our business partners, some of which are located outside of China.

If you want to designate an authorized agent to make a request to opt-out on your behalf, please contact the CHS Privacy Office in writing per the ‘How to Contact CHS Concerning Your Personal Data’ with a Power of Attorney indicating your designation of an authorized agent. If you are an authorized agent requesting on behalf of a consumer; you may be asked to provide a Power of Attorney.

 

Requests with respect to these rights will be honored within 45 calendar days of the request, but (where permissible) the time period may be extended for another 45 days for complex requests. You will be notified of the reasons required for any extension within 1 month.

Under certain circumstances, as required by law, and if you are a resident of European Economic Area, Switzerland, or the United Kingdom, you may have the following rights:

  • Request access to your Personal Data
  • Request correction of any incomplete or inaccurate Personal Data that CHS holds about you
  • Request erasure of your Personal Data when there is no need to continue processing it or you have exercised your right to object to processing (see below)
  • Object to processing of your Personal Data or withdraw your consent to processing
  • Request the restriction of processing of your Personal Data to suspend the processing, for example if you want CHS to verify its accuracy or the reason for processing it
  • Request the transfer of your Personal Data to another party

You have a right not to receive discriminatory treatment by CHS for the exercise of the privacy rights contained in this Privacy Notice and as required by law.

CHS uses EU Standard Contractual Clauses to safeguard your personal information if transferred outside of the EU.

How Long CHS Keeps Personal Information

CHS determines the appropriate retention period for personal information before CHS securely destroys it. CHS considers the applicable legal requirements related to the amount, nature, and sensitivity of the information, the necessary purposes previously listed in this Privacy Notice, and the potential risk of harm from unauthorized use or disclosure of your personal information.

In some circumstances CHS may anonymize your personal information so it can no longer be associated with you, in which case CHS may use and share the information without further notice to you. 

How You will be Notified of Changes to this Privacy Notice

CHS may change this Privacy Notice from time to time.  The updated notice will be posted with the last revised date.  You should periodically return to this Privacy Notice to understand current CHS privacy practices.  You acknowledge your continued use of CHS services after the updated notice is published and the collection, use, and sharing of your personal information is subject to the updated Privacy Notice.

How CHS Secures Your Personal Information

CHS implements and maintains an information security program which includes technical and organizational measures based on international standards and generally accepted practices. 

All CHS vendors who process personal information are required to safeguard data in accordance with the sensitivity of the data the vendor processes.

In the unfortunate event of a security breach involving your personal information, CHS will promptly take remedial actions to minimize any negative impacts to you. Where required by law we will notify you about the incident, potential impacts on you, remedial actions taken by CHS, and report such security breach to the competent government authorities.

CHS follows the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data.

How CHS Handles International Transfers of Personal Information

Please be aware CHS processes and stores personal information in the United States which may be transferred to and maintained on servers or databases located outside your state, province, country, or other jurisdiction, where the privacy laws may not be as protective as those in your location.

How CHS Manages Children’s Privacy

CHS may collect personal information from children under the age of 18 through affiliated websites, applications, contacts, or point of sale events for the purposes of employment, youth and scholarship programs, customer accounts, credit applications, and other requested services. This information may include name, contact information, family member names, education history, date of birth, demographic information, biometric, photo/video, or social security number depending on the requested services.

If you are a parent or guardian of a child under the age of 18 and would like to exercise their data subject rights on their behalf, please contact the CHS Privacy Office as identified earlier in this Privacy Notice.  CHS will work in good faith to honor your request but may be required by law to retain some or all of a child’s personal information.
